Joseph Grima has aggressively pursued the rights of
debtors in recent cases that have helped define the new
Bankruptcy Code.
His constant pursuit to protect debtor rights has
produced recent landmark decisions:
a) He litigated and won the right for debtors to
continue 401K contributions under the new laws that
became effective October 2005. The prevailing wisdom was
that the new amendments allowed only loans against 401K
plans to be repaid and for contributions to stop. Mr.
Grima’s successful litigation allowed debtors to
continue to contribute into their 401K Plans as well as
to repay loans against these Plans.
b) In 2007 he successfully appealed to the U.S.
District Court to protect a client from “predatory”
mortgage practices whereby a mortgage company ignored
the rule of law, saddling the debtor with hugh “escrow”
fees and then attempting to foreclose. Up until that
point, conventional wisdom had been that such an appeal
would not succeed.
Joseph Grima also has the highest success rate for
“confirming” consumer bankruptcy reorganizations in the
Eastern District Of Michigan, as well as one of the
highest success rates in the country. Over 90% of
